1. Acceptance of Terms.
You acknowledge that you have read, and agree

  • to be bound by these Terms of Use, and

  • to comply with all applicable laws and regulations, including without limitation U.S. export and re-export control laws and regulations regarding the transmission of technical data exported from the United States or the country in which you reside.

  • You further agree to comply with all local laws, regulations and rules regarding online conduct and acceptable Content. You represent you have the legal authority to accept these Terms of Use on behalf of yourself or any party you represent. If you do not agree to these terms, please do not purchase EverDone®.

2. Usage Rights, Third-Party Access, Duplication, Printing, Storage
The purchaser is granted a single, nontransferable license for his or her personal use of EverDone® guide and all related files.

The purchaser is not authorized to grant access to EverDone®, in whole or in part, to any third party, in particular, to sublicense, to transfer, to timeshare, or to rent out EverDone.

Making EverDone available on the Internet or in other networks, reselling the guide or system, and/or any use for commercial purposes is not permitted.  

Making copies or printouts and storing a backup copy of the guide on another device is permitted for private, personal use only. This must not give rise to third-party access.

Inclusion of the guide, in whole or in part, in a purchaser’s own print or online publication is not permitted.

Copying of EverDone® contents is only permitted for private purposes and only in the form of excerpts.

The above conditions also apply to any audio, video, or other files that accompany the guide.

2. Content Alteration, Third-Party Rights
Barring differing compelling legal obligations, the guide may not be altered by the purchaser in form or content in any way. The purchaser is not authorized to create derivative works based on the contents of the guide, nor to use these contents in any way that would infringe the copyrights in this material.

Any proprietary or copyright notices, disclaimers, digital watermarks, trademarks, onscreen notices, labels, or other marks must not be removed or suppressed from the guide in any way.

3. Accessibility
The publisher makes no warranties as to continuous unlimited access to the licensed guide. Disruptions or service failures cannot be ruled out.

The publisher reserves the right to alter, expand, limit, or discontinue the environment in which guides are made available and to remove data at any time and without further notice. The publisher accepts no liability for data losses.

4. Misuse
The publisher reserves the right to investigate occurrences of suspected unauthorized use or other contract violations and to take appropriate action, in particular, to deny the purchaser further access to the licensed guide, either in full or in part, temporarily or, in case of major violations, permanently.  

5. Customer Responsibility
Product content is developed for strictly educational purposes ONLY. Customer accepts and agrees that Customer is 100% responsible for their progress and results from the product. Company makes no representations, warranties or guarantees verbally or in writing. Customer understands that because of the nature of the product, the results experienced by each client may significantly vary. Product education and information is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. Company assumes no responsibility for errors or omissions that may appear in any product content and materials.

6. Trademarks
Unless otherwise specified, the trademarks, names, logos and service marks (collectively "trademarks") in EverDone are registered and unregistered trademarks of Harmon Enterprises. Nothing contained on this website should be construed as granting any license or right to use any trademark without the prior written permission of Harmon Enterprises.

EVERNOTE, the Evernote Elephant logo and REMEMBER EVERYTHING are trademarks of Evernote Corporation and are used under a license. This work is not written by or endorsed by Evernote Corporation or any other person, company or product recommend in the material.

Neither Stacey Harmon nor Harmon Enterprises, is licensed, certified, approved, or endorsed by or otherwise affiliated with David Allen or the David Allen Company which is the creator of the Getting Things Done® system for personal productivity. 7. Refund Policy
We stand behind our products and your satisfaction with them is important to us. However, because EverDone and the EverDone Templates are digital goods delivered via Internet download at the time of purchase, we offer no refunds. 

For subscription based purchases (the EverDone® community), payments are charged automatically depending on if the customer is on monthly or annual payment plan. There are no refunds on the monthly or annual subscription once it is charged. Subscriptions may be cancelled at any time by emailing support@harmonenterprises.com or self-cancelled via the “Manage Your Subscription” button that appears on your reoccurring subscription receipt.

If you purchased EverDone at a discounted rate as part of a bundled package (for example, as part of your Radical Productivity with Evernote purchase) and – as an exception to our no refund policy – qualify for a refund on the non-EverDone portion of your bundle purchase, your refund will be calculated on the full retail value of EverDone on the date of your purchase. In other words, any refunds granted on another product that include EverDone in its bundle, will be considered to have purchased EverDone at the full retail value (not the discounted value offered in the bundle).

8. External Links
External links may be provided for your convenience, but they are beyond the control of Harmon Enterprises and no representation is made as to their content. Use or reliance on any external links and the content thereon provided is at your own risk. When visiting external links you must refer to that external website's Terms of Use of use.

9. Alteration
Harmon Enterprises may at any time modify any relevant Terms of Use, policies or notices. You acknowledge that by purchasing EverDone, you shall become bound to the current version of the relevant Terms of Use (the "current version") and, unless stated in the current version, all previous versions shall be superseded by the current version.
