Terms of Service
The following Terms of Use are entered into by and between You and Stacey Harmon LLC dba Harmon Enterprises (“Company”, "Community Owner", “we”, or “us”).
The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use” or "Agreement"), govern Your access to and use of www.harmonenterprises.com, including all subdomains, content, functionality, and services offered on or through www.harmonenterprises.com (the “Website”), whether as a guest or a registered user.
This includes our community platform which we use to deliver products and is accessible at access.harmonenterpries.com. These terms of service include any any mobile or other downloadable applications that we make available to enable access to the product(s) purchased (collectively, the "Community"). These Terms of Service are a legally binding contract between you and Community Owner regarding your use of the Community.
Please read the Terms of Use carefully before You purchase our products. By purchasing a product or by clicking to accept or agree to the Terms of Use when this option is made available to You, You accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, incorporated herein by reference. If You do not want to agree to these Terms of Use including the agreements incorporated by reference herein, You must not purchase a product.
1. Acceptance of Terms.
You acknowledge that you have read, and agree
to be bound by these Terms of Use, and
to comply with all applicable laws and regulations, including without limitation U.S. export and re-export control laws and regulations regarding the transmission of technical data exported from the United States or the country in which you reside.
You further agree to comply with all local laws, regulations and rules regarding online conduct and acceptable Content. You represent you have the legal authority to accept these Terms of Use on behalf of yourself or any party you represent. If you do not agree to these terms, please do not purchase the product.
2. Accounts and Registration.
The purchaser is granted a single registration to the product(s) for one participant.
To access most products and the features of the Community, you must register for an account. When you register for an account, you may be required to provide us with some information about yourself, such as your name, email address, or other contact information. You agree that the information you provide to us is accurate, complete, and not misleading, and that you will keep it accurate and up to date at all times. When you register, you will be asked to create a password. You are solely responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account. If you believe that your account is no longer secure, then you should immediately notify us at info@harmonenterprises.comor by using the mechanisms made available by Community Owner.
3. Ownership; Proprietary Rights.
The Community is managed by Community Owner using a platform made available by Service Provider. The visual interfaces, graphics, design, compilation, information, data, computer code (including source code or object code), products, software, services, and all other elements of the Community provided by Community Owner or Service Provider ("Materials") are protected by intellectual property and other laws.
All Materials included in the Community are the property of Community Owner or its third-party licensors (including Service Provider). Except as expressly authorized by Community Owner, you may not make use of the Materials. There are no implied licenses in these Terms and Community Owner and Service Provider reserve all rights to the Materials not granted expressly in these Terms.
The purchaser is not authorized to create derivative works based on the contents of the training, nor to use these contents in any way that would infringe the copyrights in the material. Making this training available on the Internet or in other networks, reselling the content, and/or any use for commercial purposes is not permitted.
4. Third-Party Services.
Community Owner may provide tools through the Community that enable integration with third-party platforms, add-ons, services, or products not provided by Community Owner ("Third-Party Services"). If you direct us to transmit data to, or receive data from, a Third-Party Service on your behalf (including by enabling the applicable integration in the settings of the Community), then you authorize us and Service Provider to collect, access, use, derive, disclose, generate, transfer, transmit, store, host, or otherwise process ("Process") any such data, including User Content (defined in 6.1 below), in connection with the applicable integration, in a manner consistent with the functionality of the Community requested by you and the permissions granted to Community Owner by the relevant integration (which Processing may include, without limitation, performing queries on the data held by the Third-Party Service). You acknowledge and agree that your use of a Third-Party Service is subject to your agreement with the relevant provider of such Third-Party Service, and that Community Owner and Service Provider are not a party to such agreement. Community Owner and Service Provider do not control and have no liability for Third-Party Services, including their security, functionality, operation, availability, or interoperability with the Community or how the Third-Party Services or their providers use User Content. All data received from Third-Party Services on behalf of you as described herein will be deemed User Content under these Terms.
5. Third-Party Software.
The Community may include or incorporate third-party software components that are generally available free of charge under licenses granting recipients broad rights to copy, modify, and distribute those components ("Third-Party Components"). Although the Community is provided to you subject to these Terms, nothing in these Terms prevents, restricts, or is intended to prevent or restrict you from obtaining Third-Party Components under the applicable third-party licenses or to limit your use of Third-Party Components under those third-party licenses.
6. Accessibility
Purchase provides you access to a single account access to the training for the life of the product for one-time purchases, or the expiration of your membership. The publisher makes no warranties as to continuous unlimited access to content. Disruptions or service failures cannot be ruled out. The publisher accepts no liability for data losses.
7. Misuse
The publisher reserves the right to investigate occurrences of suspected unauthorized use or other contract violations and to take appropriate action, in particular, to deny the purchaser further access to the content, either in full or in part, temporarily or, in case of major violations, permanently.
8. Community Code of Conduct
Community hosted products are for Harmon Enterprises customers only, and its purpose is to help support improving your use of Evernote. As you can interact with Stacey and other group members in the Community and in some cases through direct messaging, the following group guidelines exist. By creating an account and using the community, you agree that you have read, agree, and will follow the Guidelines
Note:
In order to preserve a climate that encourages both civil and fruitful dialogue, if behavior that violates these Guidelines is observed, we reserves the right to immediately suspend or terminate membership in the Community. If you are removed from the group, your membership will be canceled and, if relevant, your access to any associated resources outside this community will also be revoked.
We reserve the right to moderate, delete, and/or turn off commenting on any conversation, post, or direct messaging functionality at any time for any reason.
If you are experiencing technical issues accessing the Community, email support@harmonenterprises.com and we will assist you. Questions posted in the Community related to your membership access (both technical and billing-related) will be removed and redirected to product support via email.
We reserve the right to modify the Guidelines at any time. The most current version of the Guidelines will be available here in the group. If you have questions about them or have general questions about the Community, please contact support@harmonenterprises.com.
Here's what's expected from everyone in the Community:
Keep discussions relevant.
This is a Community about Evernote training and is a space designed to help those who choose to use Evernote and posts should remain in line with this vision.
The Community is not a place to air software grievances or spread negativity about Evernote.
Although a community, this is not a social network (there's no prompt asking "What's on your mind?"). Member posts should reflect a relevant question, training, or comprehension goal. There's room in The Community for opinions, discussion and community support, but posts not adhering to the spirit of facilitating Evernote or workflow comprehension can be considered a terms of service violation.
The Community is not an official Evernote channel. For feature requests, product feedback or complaints, post in the Evernote forum (discussion.Evernote.com) or submit feedback through the app.
Profile name. This is a group of real people. Users may not be anonymous or be represented by a username in this group. You must use your verifiable real name (typically the name you used in purchasing access to Harmon Enterprises products) in your profile. At the minimum, your first name, last initial, and email address must be used. Your email address is visible only to admins unless you allow it to be seen via your preference settings. Anonymous user accounts, or accounts with usernames in the name fields, will be asked to update their profile first and last name fields to reflect their real name. If the user's true name is not added, the user will be removed from the group. If you do not agree to this guideline, you can delete your Circle account and not access this part of this membership.
English language: Although the Community has a global membership rich with members fluent in a diversity of languages, the Academy supports communication in English only.
Be kind. There's no need to be mean, rude, offensive, or political.
Don't promote, solicit, or spam. There are plenty of places on the Internet for that; this is not one of them.
9. Customer Responsibility
Product content is developed for strictly educational purposes ONLY. Customer accepts and agrees that Customer is 100% responsible for their progress and results from the product. Company makes no representations, warranties or guarantees verbally or in writing. Customer understands that because of the nature of the product, the results experienced by each client may significantly vary. Product education and information is intended for a general audience and does not purport to be, nor should it be construed as, specific advice tailored to any individual. Company assumes no responsibility for errors or omissions that may appear in any product content and materials.
10. Trademarks
Unless otherwise specified, the trademarks, names, logos and service marks (collectively "trademarks") are registered and unregistered trademarks of Harmon Enterprises. Nothing contained on this website should be construed as granting any license or right to use any trademark without the prior written permission of Harmon Enterprises.
EVERNOTE, the Evernote Elephant logo and REMEMBER EVERYTHING are trademarks of Evernote Corporation and are used under a license. This work is not written by or endorsed by Evernote Corporation or any other person, company or product recommend in the material.
Neither Stacey Harmon nor Harmon Enterprises, is licensed, certified, approved, or endorsed by or otherwise affiliated with David Allen or the David Allen Company which is the creator of the Getting Things Done® system for personal productivity. 11. Refund Policy
We stand behind our products and your satisfaction with them is important to us. However, because our products are digital goods and services delivered live via the Internet, we offer no refunds.
For membership products, payments are charged automatically depending on if the customer is on monthly or annual payment plan. There are no refunds on the monthly or annual subscription once it is charged. Subscriptions may be cancelled at any time by emailing support@harmonenterprises.com or self-cancelled via the link that appears on your reoccurring subscription receipt. Upon cancellation, you will maintain access to the end of your membership period.
12. External Links
External links may be provided for your convenience, but they are beyond the control of Harmon Enterprises and no representation is made as to their content. Use or reliance on any external links and the content thereon provided is at your own risk. When visiting external links you must refer to that external website's Terms of Use of use.
13. Alteration
Harmon Enterprises may at any time modify any relevant Terms of Use, policies or notices. You acknowledge that by purchasing, you shall become bound to the current version of the relevant Terms of Use (the "current version") and, unless stated in the current version, all previous versions shall be superseded by the current version.
